Chapter 8 Human Resources

Article 40 Personnel

1. Teachers and other staff of education institutions carry out activities of public interest.

2. Teachers should possess the appropriate qualifications related to the type of education, the level of education, the discipline or discipline area that they teach; it is governed by specific statutes.

3. The promotion criteria of teacher category should consider the factors of serenity, professional development and evaluation of performance.

4. The principal’s academic qualifications should not be inferior to the academic qualification that the teachers teaching in the highest level of the school should possess.

5. The types of work, the categories, evaluation, work load, salary, as well as related rights and obligations of teachers in public schools are governed by specific statutes.

6. The system framework of the types of work, the categories, evaluation, work load, retirement guarantee, as well as the related rights and obligations of the teachers in private schools is governed by specific statutes.

7. The personnel mentioned in Clause No. 1 can enjoy health care provided by public health institutions in accordance with the specific statutes.


Article 41 Professional development

1. Professional development is the right and obligation of the teaching staff; they should plan for their sustained professional development.

2. The professional development of teaching staff should be in line with the requirements of the education development of Macao Special Administrative Region; it should be implemented through diverse means and flexible forms of participating in trainings, self-study, survey and practice.

3. The education authority should provide conditions and resources for professional development of teaching staff.


Article 42 Training

1. Training is divided into pre-service training and in-service training.

2. Pre-service training aims to enable students to acquire the professional qualification through specially organised courses.

3. In-service training aims to enable those teachers who have not yet possessed the professional qualification to acquire the professional training and certificate, or to enhance the professional level of the qualification that they have already had.

4. Suspension of teaching for refresher courses is a form of in-service training.

5. The education authority can organise or cooperatively organise teacher training with other entities, or subsidise schools to organise school-based trainings.

6. The stipulations related to teacher training are governed by specific statutes.
